CONSENT SOUGHT: Subdivision consent to subdivide Lot 3 Deposited Plan 360520 into 15 lots for subsequent rural-residential land use and 1 balance lot to be amalgamated with the balance of land in Record of Title 246193 (being Lot 4-5 Deposited Plan 360520). Land use consent for breaches of rules under the Buller District Plan relating to access, for breaches of rules under the proposed Te Tai o Poutini Plan (TTPP) relating to access and residential density, and for subdivision and the change of use of land under the Resource Management (National Environmental Standard for Assessing and Managing Contaminants in Soil to Protect Human Health) Regulations 2011 (NES-CS).
The proposed lots in the subdivision will generally range in net size from 1.0ha to 3.0ha, with two smaller lots being 7,400m2 and 8,000m2. The proposal includes volunteered restrictions relating to the location, size, colour and materials for buildings on the proposed lots, restrictions on exterior lighting and fencing, retention of existing vegetation and new landscape/screen planting.
The proposal is a discretionary activity overall under the Buller District Plan, TTPP and the NES-CS.

How to make a submission
The application (and supporting information including an Assessment of Environmental Effects and further information) may be examined at the office of the Buller District Council, 6 Brougham Street, Westport, during normal office hours or on this page.
Any person may make a submission on the application, but a person who is a trade competitor of the applicant may do so only if that person is directly affected by an effect of the activity to which the application relates that:
(a) adversely affects the environment; and
(b) does not relate to trade competition or the effects of trade competition.
If you wish to make a submission on this application you may do so by sending a written submission to the Buller District Council on the specified form. This form can be obtained from the website or Council office.
The submission must be dated, signed, and include the following information:
- Your name and postal address and telephone number and/or fax number and e-mail address (if applicable).
- Whether you support or oppose the application or are neutral.
- Details of the application in respect of which you are making the submission, including the applicant, application number, activity and location.
- The reasons for making your submission.
- The decision you wish the Consent Authority (the Council) to make.
- Whether you wish to be heard in support of your submission.
A person who makes a submission must send a copy of it to the Applicant at the address shown above as soon as reasonably practicable after serving the submission on the Consent Authority.
